What do Nick Diaz and David Chappelle have in common – they both believe in taking the Fifth Amendment. Unfortunately, that doesn’t always help.

Yesterday, the Nevada State Athletic Commission (NSAC) gave Nick Diaz a cruel five-year suspension for testing positive for THC metabolites back in January of this year. Thinking that wasn’t enough punishment for medicating with marijuana, the NSAC then hit Diaz with a $165,000 fine, or 33% of the $500k paycheck he earned for fighting Anderson Silva in Las Vegas during UFC 183.

Receiving what amounted to a life sentence from the NSAC, the 32-year-old fighter told MMA Junkie:

“I’m pretty pissed off — First of all, this sport, this commission and everybody, they’ve done everything they can to keep me from being all the way on top where I should be. They’ve been doing everything they could to keep me from proving to the world that I’m the best fighter in the world, which I am.”

Nick’s case was seemingly undermined by his repeated invoking of the 5th Amendment during his hearing before the Nevada State athletic commission: Like Dave Chapelle’s parody, Diaz countered nearly every question by pleading the Fifth, sending the commission into fits of babbling nonsense.

After initially requesting a lifetime ban for Diaz, the NSAC relented by handing down a five-year suspension, which for the 32-year-old Mixed Martial Arts fighter is pretty much the same thing. Ignoring the fact that two of the three tests conducted on Diaz came back negative for THC metabolites, the Nevada State Athletic Commission handed down their erroneous decision based on a single test conducted by Quest laboratories – which produced the only positive test.

While he would only plead the fifth before the commission, Diaz spoke out after.
